EU Commission evaluates competition rules on technology transfer agreements

 

The Technology Transfer Block Exemption Regulation, which exempts certain agreements and practices from the EU’s general competition rules, will expire on 30 April 2026.

The EU Commission has therefore launched an initiative to evaluate how the Regulation and related guidelines are working in practice.

After a call for evidence closed in December 2022, the Commission will be conducting a public consultation during the 2nd quarter 2023 to help decide whether it should:

  • let the Regulation expire,
  • prolong the duration of the Regulation, or
  • prepare a revised Regulation and related guidelines?
