Processing of data in the context of complaints on the basis of the Digital Services Act

The Competition Authority is responsible for processing the data collected via the complaint form.

It collects data about you (surname, first name, contact details), and, where applicable, data about other people, in order to deal with your complaint and to be able to contact you.

The complaint form includes tick boxes to specify the nature of the alleged violation, explain the alleged offence and attaching documents supporting the complaint to the form. It is recommended to provide only the information necessary for handling the complaint, and, in particular, to refrain from including sensitive data such as data concerning health, political opinions or religious beliefs, unless absolutely necessary. Additional data may be required and collected at a later date by the Competition Authority in the context of handling the complaint (from the individual lodging the complaint and/or the organisation to which the complaint pertains).

Handling of the complaint on the basis of Article 53 of the Digital Services Act is necessary for performance of the public interest mission with which the Authority is invested (Article 6, paragraph 1(e) of the General Data Protection Regulation).

Data is communicated to the departments of the Authority responsible for reviewing complaints. The data collected (as long as it is useful information) may be forwarded to other digital services coordinators or to the European Commission in the context of cooperation and mutual assistance with these other authorities (Articles 57-60 of the Digital Services Act). This information is kept for as long as is necessary for the complaint to be handled.

You can access your data, oppose processing thereof, or request correction or deletion thereof. You can also exercise your right to restrict processing of your data. If, after contacting us, you feel that your rights regarding your data have not been respected, you may lodge a complaint with the National Data Protection Commission (Commission nationale pour la protection des données).
